 1. Society of Hospital Medicine Privacy Policy
This Privacy Policy explains how SHM may collect, use, share, and safeguard information on www.hospitalmedicine.org, mobile websites, microsites, mobile applications, SHM profiles on SHM social media sites, and any other digital services and platforms officially operated or used by SHM from time to time (the “Sites” or “Services”).  In certain Sites operated overseas, the Privacy Policy displayed on those ---------------------------------------------------------------------------------------Sites, not this Privacy Policy, will govern the collection, use, and sharing of information.

2. Changes to the Privacy Policy
As SHM, its membership, products and services change from time to time, this Privacy Policy is expected to change as well. We reserve the right to amend the Privacy Policy at any time, for any reason. The date of the last revision to the Privacy Policy will be indicated by the "Last updated" date at the bottom of this page.

3. Information We Collect
a. Personally Identifiable Information: We may collect information (whether online, by phone, or by paper) that identifies you (“Personally Identifiable Information”) when you: provide such information on our Sites, apply or register for SHM events, or otherwise interact with SHM, including, but not limited to, applying for membership, registering for an SHM event or program, or purchasing SHM products or services. The types of Personally Identifiable Information collected may include your name, address, phone number, birth date, billing and delivery information, Email address, information about your practice or business, credit card, or other financial account information.   
b. Non-Personal Data: As you interact with our Sites, we may also collect information about your browsing history or certain other information that is not Personally Identifiable Information through your use of and visits to the Sites and our use of a variety of technologies, including, but not limited to, cookies, tags, beacons, Internet Protocol (IP) address, and other tools. "Cookies" are pieces of code/text placed on your computer when you browse our Sites. Cookies may be placed by us or third-party advertisers. “Tags” and web beacons refer to code scripts that are primarily used to track visitors’ activities on our Sites by web analytics software. The types of non-personal data collected on our Sites using these, and other tools as SHM may add from time to time, may include: the search terms you used, new or returning user, browser information, computer type, operating system, internet service providers, website usage, referring/exit pages, platform type, date/time stamp, number of clicks, ads viewed, etc. Additionally, cookies, tags and other tools placed by third parties may collect other information about you and your visits to Sites and elsewhere on the Internet including, but not limited to, your industry, company size, job function, seniority level, etc.) (collectively, all of the foregoing data the "Non-Personal Data").

4. How We Use and Share Personally Identifiable Information
Once collected, we may use your Personally Identifiable Information in a variety of ways including, but not limited to:
  • Provide service communications such as bill reminders, order confirmations, program registrations, and customer service messages
  • Respond to your emails or online requests for products, services, or information
  • Deliver and process surveys
  • Personalize and improve the usability of the Sites
  • Fulfill and/or deliver SHM products and services
  • Publish membership directories and registration lists as described below
  • Sharing with certain other companies to offer you products and services that may be of interest to you as described below
  • Tailor content, advertising and marketing to you
  • Share with third parties as required by law or to protect SHM as described below
  • Share your email address as permitted under the SHM Email Policy as described below
Publication of Your Personally Identifiable Information for Membership Directories and Registration Lists. To allow others to find you, the Personally Identifiable Information we receive may be published on the Sites and other print or digital media, in a variety of ways, including, but not limited to, directories, membership lists, and other types of registration lists for SHM programs and events (“Directory Lists”). Directory Lists will not include sensitive information, such as credit card or bank information, or social security numbers. Users may request their information be suppressed from Directory Lists by contacting us.

Sharing Your Personally Identifiable Information to Fulfill Service Requests and Perform Business Functions. When fulfilling service requests initiated by you, we may share your Personally Identifiable Information with certain third parties to fulfill the requests. We may also share such information with service providers that perform business functions for us. For example, SHM occasionally hires other companies to provide limited services on our behalf including, but not limited to, packaging, mailing and delivering promotional offers, sweepstakes or contests, answering customer questions about products or services, consulting services, data modeling, printing, sending postal mail and processing event registrations.  In such cases, SHM may share your Personally Identifiable Information.  

Sharing Your Personally Identifiable Information with Certain Other Companies. SHM may share Personally Identifiable Information with certain other companies in order to provide them an opportunity to offer products or services that may be of interest to you, which helps contribute non-dues revenue to SHM. 

Sharing Your Personally Identifiable Information When Legally Necessary or to Protect the SHM’s Interests. SHM may disclose your Personally Identifiable Information if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process served on SHM; (b) protect and defend the rights or property of SHM; or (c) protect the personal safety of SHM personnel or members of the public in appropriate circumstances. In addition, if SHM and/or its assets (or a portion of its assets) are sold, assigned, transferred, or merged, or if SHM undergoes some other change including a change to its corporate form as part of a bankruptcy proceeding or otherwise, information may be transferred as part of that transaction or change.  

5. How to Manage the Sharing of Your Personally Identifiable Information
You can manage your profile and e-mail preferences, including opting out of e-mail either online or by contacting us. Additionally, if you prefer to receive mailings only from SHM and have your name and address removed from the list we provide to certain companies, please contact us.

6. How We May Use and Share Non-Personal Data
Through the use of various technological tools, we may collect Non-Personal Data to improve the usability of our Sites/Services and for other business reasons. We may share the Non-Personal Data we collect with third parties or permit third parties to place tools like cookies, tags and web beacons, to collect additional Non-Personal Data when you browse our Sites. We or other third-party companies may then use the Non-Personal Data to provide advertisements and targeted advertisements to you (ads based on the Non-Personal Data). We do not share Personally Identifiable Information with third parties with whom we share your Non-Personal Data. Please note that you may be subject to the privacy policies of other non-SHM companies when you select an advertising link or other link that takes you to sites not operated by SHM.  

7. Children
We do not knowingly collect personal data online from or market online to children under the age of 13.

8. Information Security
SHM implements commercially reasonable security measures to help protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. Except for Directory Lists and the sharing of information as set forth in this Privacy Policy, we restrict access to personal information to certain companies who may need to know that information in order to operate, develop, or improve our services. These individuals or partner organizations are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Accordingly, and despite our efforts, SHM cannot guarantee or warrant the security of any information you transmit to us, or to or from our online products or services. 9. User ID and Password
Certain areas of the Sites may require the use of a user ID, email address, or password as an additional security measure that helps protect your information.  To help you protect your privacy, the SHM Sites have tools to help you log in and log out.

10. Linking to Other Internet Sites
You should be aware that other Internet sites that are linked from the Sites or from an SHM email message may contain privacy provisions that differ from the provisions of this Privacy Policy. To ensure your privacy is protected, we recommend that you review the privacy statements of these other linked sites, applications, or other digital platforms.

11. How You Can Access and Change Information
If you are a registered user of the Sites, subscriber to SHM publications, purchaser of SHM products and services, or an SHM member, you may review and update/correct your information directly on the SHM’s website—

HMX Community Rules & Etiquette

Thank you for being part of our community. To ensure the best possible experience for all members, we have established some basic guidelines for participation.

By joining and using this community, you agree that you have read and will follow these rules and guidelines. You also agree to reserve discussions and shared files and content to that best suited to the medium. This is a great medium with which to solicit the advice of your peers, benefit from their experience, and participate in ongoing conversations.

The Rules
  • Don't demean or attack others. The discussions and comments are meant to stimulate conversation not to create contention.
  • Don't post commercial messages on any discussion list, resource library entry, or other areas. Contact people directly with product and service information if you believe it would help them.
  • Please refrain from posting employment opportunities or conducting employment searches within HMX communities.  If you are looking for employment or have a position to fill,  you may utilize SHM’s Career Center.
  • Use caution when discussing products or specific companies. Information posted in communities and libraries is available for all to see, and comments are subject to libel, slander, and antitrust laws. 
  • All defamatory, abusive, profane, threatening, offensive, or illegal materials are strictly prohibited. Do not post anything that you would not want the world to see or that you would not want anyone to know came from you. 
  • Surveys created by SHM member groups may be posted in the Open Forum, and within the member group community it originated. External surveys can only be posted in the Open Forum. Commercial and non-academic surveys will be removed from the platform.
  • No Solicitation.  All posts by HMX users advertising external products, services, or events will be removed from the platform
  • Please note carefully all items listed in the disclaimer and legal rules below, particularly regarding the copyright ownership of information posted. 
  • SHM reserves the right to reject any message for any reason.
     
Discussion Group Etiquette
  • Include a signature tag on all messages. Include your name, affiliation, location. 
  • State concisely and clearly the topic of your comments in the subject line. This allows members to respond more appropriately to your posting and makes it easier for members to search the archives by subject. 
  • Send a message to the entire community only when it contains information everyone can benefit from. 
  • Send messages such as "thanks for the information" or "me, too" to individuals--not to the entire list.
  • To remove yourself from a community or change your e-mail address, use the “Account Settings” function instead of making the request by posting in the community.

In no event shall SHM be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, arising out of or in connection with the use or performance of any information posted on this site.

Restrictions on Content. All users shall be responsible for conducting their HMX-related activities in compliance with all applicable laws, rules, and regulations. In addition, you agree to act with a professional demeanor. Without limiting the foregoing, you specifically agree that you will not make posts that:
  • Contain profanity; racist, sexist, or homophobic comments; harass or stalk any person; or contain defamatory statements or personal attacks on others;
  • Disrupt other user’s enjoyment of the Community;
  • Are made under another person’s name or impersonate anyone;
  • Use Communication Services for political campaigning, recruiting votes, or soliciting political campaign support;
  • Conduct or forward surveys, contests, pyramid schemes or chain letters;
  • Harvest or otherwise collect information about others, including email addresses, without their consent;
  • Contain personal details or private information about any other person or any confidential information or any information that would infringe upon the proprietary, privacy, or personal rights of others;
  • Breach any intellectual property rights law (including posting material protected by copyright without the permission of the copyright owner or using any words, logos, or other marks that would infringe upon the trademark, service mark, certification mark, or other intellectual property rights of the owners of such marks without the permission of such owners);
  • Contain any advertisements or promotions for any products or services of you or another party
  • Contain recruiting information, employment opportunities/available positions, or inquiries about employment opportunities;
  • May be considered spamming or contain chain letters or any other form of unauthorized solicitation, including the solicitation of lawsuits;
  • Messages should not be posted if they encourage or facilitate members to arrive at any agreement that either expressly or impliedly leads to price fixing, a boycott of another's business, or other conduct intended to illegally restrict free trade. Messages that encourage or facilitate an agreement about the following subjects are prohibited: prices, discounts, or terms or conditions of sale; salaries; profits, profit margins, or cost data; market shares, sales territories, or markets; allocation of customers or territories; or selection, rejection, or termination of customers or suppliers.
  • Violate U.S. export laws or encourage illegal activity of any kind.
HMX is not intended to be a place for the exchange of any information or data that would be regulated by the federal Health Insurance and Portability Act (HIPAA) of 1996 and its implementing regulations.  Do not post any Protected Health Information, as that term is defined in HIPAA, to the Community. SHM shall not be liable for any use or disclosure of Protected Health Information in violation of HIPAA through the Community, including, but not limited to, the transmission of Protected Health Information to an unintended recipient. 

User Posts. By posting material, the posting party warrants and represents that he or she owns the copyright with respect to such material or has received permission from the copyright owner. In addition, the posting party grants SHM and users of this site the nonexclusive right and license to display, copy, publish, distribute, transmit, print, and use such information or other material. Once you have made a posting, you cannot withdraw or retract the license and consents. By posting on the Community, you acknowledge that the material is not confidential and agree that other users of the Community may copy, use, transmit, modify, distribute, and display the content you post.

Monitoring and Enforcement. SHM does not actively prescreen, verify, or edit the content posted by users in the HMX Community. However, SHM reserves the right to monitor any and all information transmitted or received through HMX. SHM, in its sole discretion and without further notice to you, may review, censor, or prohibit the transmission or receipt of any information that SHM deems inappropriate or that SHM determines violates its Terms. SHM has the sole discretion to enforce these terms.
